Terms and conditions of entry

1. General

a) Information on how to enter forms part of these conditions. Entry into the competition constitutes acceptance of these terms and conditions.
b) The Promoter is carsales.com.au Ltd, 77 Atherton Road, Oakleigh, Victoria 3166. ABN 91 074 444 018
c) For the purposes of these Terms and Conditions, carsales.com.au Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees, and assigns.

2. Entry Requirements

a) Entry is only open to Australian residents who are 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
b) The promotion commences at 4:00am AEST on Wednesday 9th January 2008 and entries close on at 11:59pm AEST on Tuesday 26th February 2008 (the Promotion Period).
c) To enter the draw, participants must visit http://www.boatpoint.com.au and participate in the 'Win a Sea Doo RXT with BoatPoint and The Boatique' competition where entrants need to find a Sea Doo 2008 RXT X on the www.BoatPoint.com.au website. Once the Sea Doo ad has been 'found' the participant is eligible to enter the draw for the chance to win one (1) Sea Doo 2008 RXT X with Trailer and Safety Equipment.
d) For the purpose of this competition each unique email address constitutes a unique person.
e) There is a limit of one entry per person per day during the promotional period.
f) Entrants may 'refer a friend' to the competition by entering their name and email address in the entry form. A referral email will be automatically sent to the friend inviting them to enter the competition. This referral email is subject to the Spam Act 2003. Each friend may only be nominated once during the promotion period and entrants who have already entered the competition cannot be nominated as a friend. If a valid nominated friend enters the competition through the referral email, then the original entrant who nominated them will receive one additional entry into the draw.

3. Prizes

a) The first eligible entry drawn on Wednesday 27th February 2008, will win an "Ultimate Summer Pack" which includes a Sea Doo 2008 RXT X, a trailer, registrations and safety equipment, 12 months Club Marine insurance, Waeco Cool Freeze Unplugged CG-32UP Fridge, a $250 Helly Hansen Clothing Gift Voucher and a pair of Serengeti Sunglasses. The 'Ultimate Summer Pack' has a total retail value of $29,339. The second eligible entry drawn on the draw date will win the "Stay Cool Pack" which includes a Waeco cool Freeze Unplugged CF -32UP fridge, a $250 Helly Hansen Clothing Gift Voucher, and a pair of Serengeti Sunglasses. The 'Stay Cool Pack' has a total retail value of $1,899. The third eligible entry drawn on the draw date will win a "Summer Pack" which includes a $250 Helly Hansen Clothing Gift Voucher and a pair of Serengeti Sunglasses. The 'Summer Pack' has a total retail value of $700. There is a total of three (3) prizes with a TOTAL retail value of $31,938. The winners will be notified in writing. Their name will be published on http://www.boatpoint.com.au and published in The Australian on Friday 2nd March 2007.
b) Prize may not be transferred or substituted except at the Promoters discretion. The Promoters reserve the right to substitute a prize of equal or greater value due to prize unavailability. Any tax on any prize is the responsibility of the winner. Independent financial advice should be sought by any person participating in this promotion.
c) The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the Internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries.

4. Draw

a) The draw will take place at 77 Atherton Road, Oakleigh, Victoria 3166.
b) The winner will be chosen by a random electronic draw process. The judges' decision is final and no correspondence will be entered into.
c) The draw and publication dates for the above mentioned competition are as follows:

d) Winner will be notified via email and phone contact on the draw date.
e) The winners details will be published in The Australian newspaper - date as above.
f) The Promoter reserves the right to redraw in the event of any entrant being unable to satisfy these competition conditions or forfeiting or not claiming any prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw or draws, as required, at the same time and place as the original draws but on 30th June 2008. The winner/s of these subsequent draws will be published on http://www.boatpoint.com.au on 2nd July 2008 and in The Australian newspaper on 2nd July 2008.

5. Intellectual Property

a) All entries become the property of the Promoter. By entering the promotion, and unless otherwise advised, each entrant also agrees to be entered into a database and the Promoter may use the entrants' names, addresses, telephone numbers and the winners' names and addresses and photographs for future promotional, marketing and publicity purposes in any media worldwide, including sending the entrant electronic messages, without notice and without any fee being paid unless otherwise advised by the entrant.
b) The Promoter may require an entrant or prize winner to execute any document necessary to give effect to item 2a).

6. Warranties

a) The Promoter does not take any responsibility for any costs associated with entering and/or accessing this competition including and not limited to Internet service provider costs.
b) If for any reason this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in it's sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.
c) In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to state legislation.
d) If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently to the Promoter may deem that prize winner ineligible.
